根据《校车安全管理条例》第一章第二条的规定，校车是指依照本条例取得使用许可，用于接送义务教育的学生上下学的7座以上的载客汽车。有学者认为，危险驾驶罪中的校车业务应严格按照条例中所规定的校车进行定义，仅限于接送义务教育阶段学生上下学的车辆，接送其他学生的车辆即便其符合严重超载超速的情形时，也不能成立危险驾驶罪
