Obligation to deliver (Clause 3) – the contract require shipments to be delivered in December 2019 to January 2020. Since it is now already July 2020, it is not clear why the relevant shipments have not been made. Without an explicit agreement to extend delivery dates, it would appear that the Seller may argue that it has no obligation to make further delivery, even though they would appear to have breached their contractual obligation to deliver (I am assuming that the Buyer has done everything it was required to do under the contract within the time period for designation of ships etc). I note that there is an e-mail for later delivery, but please note that amendments (Clause 16) should be in the form in the form of an addendum, and there is an entire agreement (Clause 23) clause.
