4.04 Sub-soil conditions and investigation reportsThe Contractor shall accept the Site and take possession and maintain all hoardings / covered walkways including painting, graphics and lighting, fence, gantries, temporary enclosures, barriers, footways, gangways, temporary or permanent surface and/or underground drainage, etc. as found on the Date for Possession. The Contractor will be required to relocate and modify the same to suit the progress of work and in compliance with the Architect's Instructions and at his own expense clear the Site of any debris which may have been left there.The Employer shall have no responsibilities for any change in the conditions of the Site after the time of tender.The Contractor shall note that the site investigation report, existing survey and records for public utility services, foundation drawings of previous/existing structures, etc. as listed in the List of Tender Information / Drawings in the Tender Documents are issued for information. All of the information is for the Contractor’s reference only.The above site investigation reports and information which may be made available to the Contractor are given in good faith but for reference only; and should it be relied upon by the Contractor, it would be done so at the Contractor’s risk. Any such reports or information provided to the Contractor shall not relieve the Contractor from any of its obligations under the Contract.The Contractor may encounter surface and underground obstructions during the execution of the Works. The Contractor shall be solely responsible for the removal and/or diverting such surface and underground obstructions of whatever nature, including boulders and solid rock, plain and reinforced concrete, services, and any artificial materials met with during execution of the Works at his own expense. The Contractor is deemed to have included in the Contract Sum all costs and expenses for removing and diverting the underground obstructions and utilities and shall absorb all risks associated with the uncertainties and unforeseen circumstances of the underground and soil conditions.For the avoidance of doubt, the Contractor acknowledges that the risk of all sub-soil conditions and underground condition of whatsoever nature is and remains with the Contractor.No claim for extra payment or extension of time will be allowed on the grounds of ignorance of the conditions under which the Work is to be carried out.
