Clause- 4.3: If the Buyer doesn’t collect the Goods in the period fixed by the Seller, the Goods will be stored in the Seller’s warehouse for 10 (ten) days free of charge. For each following day of storage, the Buyer shall compensate to the Seller expenses incurred by the Goods storage in amount of 400 euro per each calendar week of storage per each unit of the Goods. This sum is compensation of expenses by Buyer to Seller and shall be not considered as penalty (fine). Is 400 € per week OK?Clause 8.2 Warranty: Are you OK with the periods specified in yellow below? (4 months and 45 days)8.1 Warranty means that the Seller warrants high quality of the Goods. The Warranty shall include the design, materials, and manufacturing defects. The Seller shall hereby undertake to make good the manufacturing defects in a way it finds the most appropriate.8.2 Warranty period for the equipment is 24 months after commissioning, but not later than 36 months after completion of the Factory Acceptance Tests (FAT), whichever will happen first. However, as the fundamental principle, the Seller’s Warranty shall be valid if and only if the Seller supervises the installation, site tests, commissioning. The Goods shall be energized only after the approval of such site tests by the Seller’s Quality Division; otherwise, the Warranty shall be null and void.During the warranty period the Seller shall replace faulty Goods, cover the transportation costs for their dispatch to the Buyer at its own expense within time, determined for each case separately, but not more than 4 (four) months, or warranty repair within 45 (forty-five) days.
