If any failure of the Goods to meet the warranty is discovered prior to the expiration of the warranty period and CONTRACTOR is notified thereof, CONTRACTOR will at its sole risk and cost promptly perform all Remedial Actions. Apart from pipes and sumps (see text below), the warranty against corrosion is 6 years from the acceptance date of equipment delivery at COMPANY’s location.3. CONTRACTOR’s warranty specifically for pipes and sumps will apply for a period of 20 years from date of commissioning and acceptance. 4. The scope of the warranty applicable to all products covered in this framework agreement include product prices (e.g. spare parts) and any transportation and labor cost (including e.g. needed civil works). 5. The product warranty scope does not include product failures due to installation mistakes as CONTRACTOR is accountable for proper commissioning. See SECTION IV – 1. SCOPE OF THE GOODS AND SERVICES PROVIDED for details.6. The product warranty scope shall also include the resolution of equipment issues, which resulted from the ordering of wrong/not fit for purpose products following site design (examples: wrong suction pumps or wrong pipe diameters in Bill of Material), if CONTRACTOR was involved in related design work or if needed information was not covered in related L2/L3 certification training.7. The parts/devices which are manufactured by other than CONTRACTOR. These are warranted based on the original manufacturer’s warranty conditions from the date of commissioning and acceptance or from the date of shipment (B/L date) whichever occurs first. CONTRACTOR shall forthwith remedy such defects at CONTRACTOR own expense by way of either repair or replacement.
