THE BEDDING SHEET RECITED IN TURSI SHOULD BE FITTED SHEET OR BED SHEET, SO THE BEEDING SHEET CANNOT BE REGARDED AS THE 2ND COVER OF THE PRESENT APPLICATIONFurther, Applicant submits that it would be impropriate to regard the “bedding sheet” as the second cover of the present application. In Tursi, according to paragraph [0056], it recites that “when in use, the mattress 10 may be covered by textile bedding sheet. Applicant submits that the entire drawings of Tursi does not show such “textile bedding sheet.” The so called “textile bedding sheet” only appears in paragraph [0056]. There is no further definition of the “textile bedding sheet” in the whole specification of Tursi. For the knowledge of one skilled in the art, the “textile bedding sheet” in Tursi should be interpreted to be the commonly used “bedding sheet” or “fitted sheet” that is used to cover the mattress to prevent user’s sweat seeping into the interior of the mattress. Applicant submits that unless there is any further definite explanation described in the whole document of Tursi, the “bedding sheet” recited in Tursi should not be regarded as the 2nd cover of the present application, so Tursi does not teach the feature “the second cover covers the first mat, second mat, and the first cover” of the present application.”Based on the reasons above, applicant believes that the rejection of the amended claim 1 of proposal 1 under 35 U.S.C. should be no longer applicable.
