Expert Determination23.5. The Expert will be selected by agreement between the Parties (acting reasonably). Should the Parties fail to agree and appoint an Expert within ten (10) Business Days of agreement to refer the matter to an Expert, the Expert shall be chosen by the Chief Executive Officer for the time being of the Centre for Effective Dispute Resolution or its replacement organisation from time to time.23.6. Each Party shall co-operate fully with the Expert and shall promptly provide the Expert with any information he reasonably requires on request.23.7. The Expert shall be instructed to deliver his decision to the Parties within ten (10) Business Days after delivery to him of the information referred to in Clause 23.5 above.23.8. Any decision of the Expert shall be final and binding, and not subject to appeal except in the case of a clear and obvious mistake or if his decision is one which no reasonable expert could have made.23.9. The fees of the Expert shall be borne by the Parties in whatever proportion as the Expert decides having regard (amongst other things) to the conduct of the Parties.
